Terms and Conditions

Please read these Terms and Conditions carefully before submitting an application to The Actor’s Lounge. By submitting an application or making a Booking for a Course, you agree to be bound by the following Terms and Conditions.

These Terms and Conditions are made between The Actor’s Lounge Ltd (“we”, “us”, or “our”) and the individual applying for or booking a Course (“you” or “Participant”).

1. About Us and How to Contact Us

The Actor’s Lounge delivers all Courses. Office hours are 9.30am–5pm (GMT/BST), Monday–Thursday except Bank Holidays (hours may vary out of term time).

2. Bookings

Your Booking creates a Contract for the Course only when we have confirmed acceptance. We may accept or decline Bookings at our discretion and will notify you of our decision as soon as reasonably possible. You are deemed a consumer unless you notify us otherwise.

The Contract continues until the completion of the Course unless ended earlier in accordance with these Terms.

3. Late Applications

For Bookings submitted within two working days of the Course starting, we will use reasonable endeavours to confirm your place promptly. Induction materials may not be received before your first session.

4. Accuracy of Booking Data

You confirm that all information supplied is accurate, complete and up to date. We may cancel your Booking without refund or any other liability to you, if information is found to be false or misleading.

5. Minimum Requirements

You must ensure you hold the correct immigration status or visa to study in the UK (not required for online Courses).

Minimum requirements may include age, English proficiency, relevant experience, and sufficient emotional and physical stamina. Our Courses involve exploration of emotion and psychology; a good level of mental stamina is essential.

If you do not meet minimum requirements, we may cancel your Booking. We will always consider reasonable adjustments where they do not fundamentally alter the nature of the Course in accordance with the Equality Act 2010.

Cancellation under this clause shall not constitute a breach of these Terms and Conditions.

6. Right to Decline Applications on Safety Grounds

We may refuse or withdraw an application where we reasonably believe that participation would present a safeguarding, wellbeing or safety risk to you or to others. Any such decision will be made with care and with regard to our duty to maintain a safe learning environment. We reserve the right to retain all or part of the full fee. Refusal or withdrawal under this clause shall not constitute a breach of these Terms and Conditions.

Any refund decision will be made in accordance with these Terms and Conditions and your statutory consumer rights. Please refer to clause 16 (Cancellation & Refunds) for further details.

7. Minimum Age Requirement

We only accept Participants aged 18 or over. By booking, you confirm you are 18 or over. If we cannot verify this, we may suspend your place while we investigate. We reserve the right to retain all or part of the full fee.

Any refund decision will be made in accordance with these Terms and Conditions and your statutory consumer rights. Please refer to clause 16 (Cancellation & Refunds) for further details.

8. Access Needs and Reasonable Adjustments

If you require adjustments, please notify act@theactorslounge.co.uk before booking where possible.

Information disclosed will be shared only with staff delivering the Course and only where necessary. Processing is carried out under legitimate interests or substantial public interest where applicable.

Where a Participant’s needs, behaviour or required adjustments have a significant impact on the safety, wellbeing or learning experience of others, and where reasonable adjustments cannot reduce that impact without fundamentally altering the nature of the Course, we may need to pause or withdraw your place. Such decisions are made carefully, on a case-by-case basis, with full regard to our duties under the Equality Act 2010 and our responsibility to maintain a safe and effective learning environment for all Participants.

9. Health Conditions Affecting Safe Participation

Acting and movement work may involve physical activity, close-contact exercises and psychologically demanding material. You must inform us of any physical or medical condition which may affect your safe participation in movement, performance or practical work. This enables us to take reasonable steps to support you and, where appropriate, identify reasonable adjustments. Failure to disclose relevant information may limit our ability to ensure your safety and may result in us pausing or suspending your participation on safety grounds.

10. Emotional Readiness and Non-Therapy Notice

Acting training may involve physical movement, improvisation, reflective exercises, emotional exploration, and psychologically demanding material.

The Actor’s Lounge is not a therapeutic service, mental-health provider, or clinical environment. Our tutors do not act in therapeutic roles. The Course is not counselling, psychotherapy, mental-health treatment, or a substitute for professional support.

We do not assess or advise on mental health suitability. You are responsible for considering your own wellbeing and seeking independent professional advice if uncertain whether you can safely participate. By booking, you confirm you have considered the emotional demands of the Course and believe you are able to participate safely.

If we reasonably believe your participation is causing significant distress, is unsafe, or affects other Participants, we may pause your place, request external advice, or withdraw you from the Course if necessary to ensure safety.

Where a Participant cannot continue due to emotional readiness or wellbeing concerns, a refund decision will be made in line with these Terms and Conditions and your statutory consumer rights. Please refer to clause 16 (Cancellation & Refunds) for further details.

You may ask questions about Course content via act@theactorslounge.co.uk, but we cannot provide therapeutic or clinical advice.

11. Creative Content and Sensitive Material

Acting training involves working with a wide range of human experiences. As part of the Course, you may encounter strong language, mature themes, emotionally challenging material, simulated conflict and other content that reflects the realities of dramatic texts and performance practice. We handle all material responsibly, provide context for the work, and always aim to create an environment where you can engage with the work confidently and with clear consent.

If you have concerns about particular themes or exercises, you are encouraged to speak with your tutor so that they can discuss these with you. We work on the basis of informed consent: you are free to let us know at any time if you are uncomfortable and wish to step back from a specific exercise, moment or piece of material.

If a tutor has concerns about your wellbeing or safety while engaging with sensitive content, they may suggest pausing your involvement so that we can check in and consider the most appropriate way forward. This may include taking a short break, adjusting your level of participation, or exploring alternative options where feasible and without fundamentally altering the nature of the Course. Our aim is always to support your wellbeing while maintaining a safe and positive learning environment for the whole group.

12. Health and Safety

You must follow all instructions, signage and safety guidance. You must not, through action or inaction, put yourself or others at risk.

Fire exits are clearly marked; follow evacuation instructions promptly. Accidents, injuries and concerns must be reported to your tutor or student@theactorslounge.co.uk as soon as possible.

We do not limit liability for death or personal injury caused by our negligence as required by law.

Courses take place in third-party venues. You must comply with all venue rules, health and safety notices and emergency procedures at these locations. The Actor’s Lounge is not responsible for loss, damage or disruption arising from venue-specific issues except where caused by our negligence.

We are responsible only for the actions of tutors when they are acting on our behalf during scheduled Course delivery. Tutors are independent contractors and The Actor’s Lounge is not liable for any advice, communication or activity they provide outside that scope.

13. Equality, Diversity and Inclusion (EDI)

We are committed to dignity, respect and inclusion. Discrimination, harassment or victimisation on any protected characteristic under the Equality Act 2010 will not be tolerated.

Where adjustments are needed, we will work collaboratively within reasonable limits consistent with the nature of the Course. Where a Participant is unable to access the physical space due to an access need, we will explore whether any elements of participation can be delivered in an alternative format, where feasible and without fundamentally altering the nature of the Course.

Where a Participant’s needs, behaviour or required adjustments significantly affect the safety, wellbeing or learning experience of the group, and where reasonable and feasible adjustments cannot resolve this without fundamentally altering the nature of the Course, we may need to pause your participation and consider the most appropriate way forward. Any decision of this kind is made with great care, on a case-by-case basis, and in line with our duties under the Equality Act 2010 and our responsibility to maintain a safe and supportive environment for all.

You must contribute to a safe and respectful environment. Behaviour undermining dignity, safety or wellbeing may result in removal without refund.

EDI concerns should be emailed to student@theactorslounge.co.uk. These commitments operate alongside emotional readiness requirements to ensure safe engagement in emotionally and physically explorative work.

14. Fees and Payment

Fees are payable in GBP. All Fees are inclusive of VAT (where applicable), unless expressly stated otherwise. International payments may incur bank charges. Payment in full or the first instalment is required at the time of Booking unless otherwise agreed.

A place cannot be reserved without payment of the deposit, full fee or first instalment.

Course Fees are correct at the time of Booking. Prices may change in future, but changes do not affect existing Bookings.

The Actor’s Lounge may, from time to time, offer promotional pricing, competitions or prize draws. Such offers are entirely discretionary and may be amended or withdrawn at any time. Eligibility criteria, closing dates and any additional terms will be stated clearly at the time of the promotion.

Promotional prices must be applied at the time of Booking and cannot be applied retrospectively to existing Bookings. Prize draws are free to enter only where expressly stated and winners are selected at random using a fair and transparent method.

Promotional offers cannot be transferred, exchanged or redeemed for cash unless we explicitly confirm otherwise at the time of the promotion. Where a Participant cancels their Booking, refunds are calculated based on the amount actually paid, not the full standard Course Fee.

Participation in any promotional offer or prize draw is subject to these Terms and Conditions and any additional rules published at the time of entry.

15. Deposit and Instalments

We offer payment by full payment, instalments or, where available, payment of a deposit to secure your place.

A deposit secures your place. Remaining Fees are due no later than 15 days before the Course start date. Bookings made within 21 days of the Course start date require either full payment upfront or payment of the first instalment. Instalment deadlines must be met.

If an instalment payment is not received by the due date, we reserve the right to pause your place on the Course until payment is brought up to date. Continued non-payment may result in termination of the Contract in accordance with clause 19.

16. Cancellation & Refunds (Consumer Rights)

16.1 Cancellation Policy

Under the Consumer Contracts Regulations 2013, you have the right to cancel your Booking within 14 days of the date you make payment. If the Course begins within this 14-day period, you will be required to pay for any part of the Course that has already been delivered up to the point of cancellation.

After the 14-day cancellation period has ended:

  • Cancellation 21 or more days before the Course start date: A refund will be issued minus a 20% administrative fee, reflecting reasonable costs incurred in relation to your Booking.
  • Cancellation fewer than 21 days before the Course start date: No refund will be issued.
  • Once the Course has started: All Fees are fully non-refundable, subject to the cancellation period referred to above;

Failure to attend all or part of a Course shall not entitle you to a refund or credit.

Fees cannot be transferred to another Course. For the avoidance of doubt, this does not prevent us from offering a deferral in accordance with clause 15, where appropriate and at our discretion. Your statutory rights under the Consumer Rights Act 2015 remain unaffected.

16.2 Deferral to a Future Term

Deferrals are offered at our discretion and are not guaranteed. A one-time discretionary deferral of your place on a Course may be granted if requested in writing to student@theactorslounge.co.uk. Deferrals are subject to a £50 admin fee.

Conditions:

  • One deferral per Booking
  • Deferral only to the same or equivalent Course as identified by us
  • Fee differences must be paid if the future Course is more expensive
  • No refund if the deferred place is not taken
  • Instalment schedules continue as agreed
  • Deferral may not be used in place of a refund
  • Deferrals must be applied to the upcoming term and cannot be used for any subsequent terms

When deferral is granted, the original place is released and the Contract will continue for the deferred term.

16.3 Cancellations by The Actor’s Lounge

We may reschedule or cancel a Course due to low enrolment, tutor availability, safety concerns, adverse weather, other operational reasons or Events Outside Our Control.

If a Course cannot run, we will notify you where reasonably possible, at least 7 days before the Course start date. Our sole liability shall be limited to providing you with the option to:

  • Transfer to another Course (with fee adjustment if required); or
  • Receive a full refund of Course Fees

We will not refund travel, accommodation, materials or other costs.

16.4 Refund Process

Refunds are made to the original payment method wherever possible.

Refunds are issued in GBP; we are not responsible for currency fluctuations. Refunds may take up to 10 working days.

17. Our Right to Make Changes

We may make changes to tutors, timetables, dates or locations where reasonably necessary. We will provide notice where possible.

If a session cannot run, we will make reasonable efforts to reschedule. We are not responsible for disruption caused by events outside our control.

We may temporarily suspend or postpone a session in order to deal with operational issues, tutor illness, venue unavailability or other Events Outside Our Control. We will make reasonable efforts to reschedule any missed hours. Suspension or delay does not entitle you to a refund unless we are unable to deliver the rescheduled session.

18. Conduct

Participants must adhere to our Code of Conduct. Acting training requires maturity, sensitivity and professionalism.

Where concerns arise, we will follow a fair and proportionate process unless immediate action is required for safety reasons.

Where Courses and communications are online, you must ensure that all communication, participation, messaging, emails, video interactions and use of online learning platforms is respectful, professional and in line with The Actor’s Lounge Code of Conduct. Inappropriate, disruptive or offensive behaviour in online settings will be treated in the same way as misconduct in in-person sessions or communication.

19. Our Right to End the Contract

We may end the Contract if you:

  • Breach the Code of Conduct
  • Disrupt learning for others
  • Damage property or endanger safety
  • Abuse or threaten staff or Participants
  • Fail to pay required Fees
  • Fail to maintain valid immigration status

No refund will be issued where the Contract is ended for these reasons. We will normally inform you in writing unless immediate action is required.

20. Safeguarding

The Actor’s Lounge works exclusively with adults aged 18 or over. While our Participants are not children, some may have additional needs and/or be considered adults at risk. We follow adult safeguarding best practice and applicable guidance.

All Participants receive a copy of the Safeguarding Policy.

21. Your Obligations

You must:

  • Maintain valid immigration status
  • Attend sessions punctually and inform your tutor of absences
  • Ensure sufficient English proficiency (recommended CEFR B2 / IELTS 6)
  • Not record sessions
  • Follow health and safety rules
  • Behave respectfully in all communications
  • Bring required materials
  • Use facilities only during scheduled hours
  • Not share login details or Course content with third parties
  • The use of audio or visual recording devices, screen-recording software, artificial intelligence tools or similar technologies to capture, reproduce, imitate, simulate or distribute any part of a Course, tutor content or another Participant’s performance is strictly prohibited. This includes creating or sharing AI-generated images, audio or video of tutors or Participants. Breach of this clause may result in immediate removal from the Course and may lead to legal action.
  • We may update our Safeguarding, EDI, Complaints, Code of Conduct or other internal policies from time to time to reflect changes in law or best practice. Participants will be notified of any significant updates. Updated policies will apply to ongoing and future Courses.
  • Regular attendance and punctuality help you get the most from the Course and support the progress of the whole group. If you miss sessions or arrive late on a recurring basis, this may naturally limit the extent to which you can take part in certain exercises, rehearsals or Showcases. Tutors may adjust your involvement where needed to maintain a positive learning experience for everyone. Absences, for any reason other than The Actor’s Lounge’s own cancellation, do not entitle you to a refund, replacement session or transfer.
22. Assessment and Spotlight Accreditation

To qualify for Spotlight Accreditation you must:

  • Complete 6 terms over 3 years
  • Attend at least 8/10 sessions per term
  • Attend at least 4/6 Showcases

We issue digital confirmation of attendance only.

23. Insurance

We hold public liability insurance. You should insure personal possessions and any costs you may lose due to illness or accident.

We do not exclude liability for loss or damage caused by our negligence.

26. Photographic and Video Consent

We may take photographs and video recordings during Courses, rehearsals, showcases and events for documentation, safeguarding, educational and quality-assurance purposes. This internal use is carried out under our legitimate interests and does not require separate consent. These materials are not shared publicly unless you have given explicit consent for marketing use.

Marketing photographs or videos (including those used on our Website, social media or publicity materials) will only be used where you have expressly given us your consent. You can provide or withhold this consent at the time of Booking, and your choice will not affect your ability to participate in the Course.

You may withdraw your marketing consent at any time by contacting act@theactorslounge.co.uk. Withdrawal of consent applies to future use only and does not require us to remove materials already published or circulated before withdrawal.

For public-facing events such as end-of-term showcases or performances, we may film or photograph the event for archive, promotional and security purposes. Audience members will be notified that filming is taking place as part of our legitimate interests in running and promoting the event. Where a Participant has not consented to promotional use of their image, we will take reasonable steps to avoid identifiable use of their image in marketing materials.

Any personal photographs or recordings taken by Participants during the Course must be for private use only and must not be shared publicly without explicit permission from all identifiable individuals, including The Actor’s Lounge.

If you become aware of images being used inappropriately or without permission, you must notify us immediately.

All photographs, video and audio taken by or for The Actor’s Lounge remain the property of The Actor’s Lounge.

27. Intellectual Property

27.1 Use of Course Materials

All Course Materials, content and resources provided or made available by or on behalf of The Actor’s Lounge (including exercises, session notes, tutor notes, curricula, recordings, slides and any related documentation) and all intellectual property rights in them are and shall remain the exclusive property of The Actor’s Lounge or its licensors.

27.2 Licence to Use

Participants are granted a personal, non-exclusive, non-transferable and revocable licence to use Course Materials solely for their own private study and learning in connection with the Course for the duration of the Contract and thereafter for personal reference only. This licence is subject to these Terms and Conditions and any use outside the scope of this licence is prohibited.

27.3 Restrictions

You shall not record, reproduce, distribute or commercialise any part of the Course or Course Materials without our prior written consent, which we may grant, withhold or condition at our sole discretion. This includes, but is not limited to, using any audio or visual recording devices, screen-recording software or similar technologies to capture or distribute any part of a Course, tutor content or another Participant’s performance.

27.4 No Transfer Rights

Except for the licence in clause 27.2, nothing in these Terms transfers, assigns or grants any ownership or other intellectual property rights in the Course Materials or in any other identifiers of The Actor’s Lounge. All rights not expressly granted are reserved. Any consent given by us may be withdrawn on written notice.

27.5 Further Assurances

We reserve the right to seek appropriate remedies for any unauthorised use of the Course Materials.

28. Use of Data (UK GDPR)

We process Personal Data under UK GDPR and the Data Protection Act 2018 for purposes connected with your participation, safety and our legitimate interests. See our Privacy Notice for full details.

Participants have GDPR rights including access, correction, erasure and restriction. Retention periods and full rights are set out in our Privacy Notice.

29. Liability

Except where we are at fault, we are not responsible for loss or damage you suffer in connection with the Course.

Nothing in these Terms excludes or limits liability where unlawful to do so, including liability for:

  • death or personal injury caused by our negligence
  • fraud or fraudulent misrepresentation
  • failure to provide Services with reasonable care and skill

Attendance involves inherent risks associated with public settings (e.g. exposure to illness). You participate at your own risk except where we are negligent.

We do not guarantee any particular outcomes, including but not limited to skill level, employment opportunity or professional development from attendance at a Course.

We are not liable for indirect or consequential loss, including loss of opportunity, reputation, income or professional prospects, except where required by law.

30. Acknowledgements and Definitions

By booking, you acknowledge and agree that the following definitions apply for the purposes of these Terms and Conditions.

30.1 “Booking” means a confirmed registration for a Course or Service made by a Participant through the Website or by any other method accepted by us, and subject to payment in accordance with these Terms.

30.2 “Course” means any acting training programme, term, workshop, class, or related educational provision delivered by The Actor's Lounge.

30.3 “Course Materials” means all materials, content and resources provided or made available by or on behalf of The Actor’s Lounge in connection with a Course.

30.4 “Data Protection Laws” means all applicable UK data protection and privacy legislation in force from time to time, including the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018, and any other applicable laws or regulatory requirements relating to the processing of personal data.

30.5 “Event Outside Our Control” means any act or event beyond our reasonable control, including but not limited to acts of God, fire, flood, storm, pandemic, industrial dispute, governmental restriction, interruption to utilities, or failure of third-party suppliers.

30.6 “Fees” means the charges payable by the Participant for a Course, as published on the Website or otherwise communicated at the time of Booking.

30.7 “Services” means the provision of acting training, teaching, workshops, events, or any other related services supplied by The Actor's Lounge.

30.8 “Participant” means any individual who registers for or attends a Course or receives Services from The Actor’s Lounge.

30.9 “Personal Data” has the meaning given to it under Data Protection Laws and refers to any information relating to an identified or identifiable individual.

30.10 “Sensitive Personal Data” means personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic or biometric data, data concerning health, or data concerning a person’s sex life or sexual orientation, as defined under Data Protection Laws (also known as “special category data”).

30.11 “Website” means www.theactorslounge.co.uk and any associated subdomains operated by The Actor’s Lounge.

30.12 “Writing” includes email.

31. Entire Agreement

These Terms and Conditions constitute the entire agreement between the parties.

Each party acknowledges that in entering into these Terms it does not rely on any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in this agreement.

32. Severability

In the event that one or more of the provisions of this Agreement are found to be unlawful or otherwise unenforceable, the rest will continue to apply.

33. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
