By submitting an application to The Actor's Lounge, you agree to the following terms and conditions:

About Us and How to Contact Us

The Actor’s Lounge courses are delivered by The Actor's Lounge. The Actor's Lounge office hours are 9.30am - 5pm (GMT/BST) Monday to Friday except Bank Holidays. Please note that office hours may differ out of term time. You can contact The Actor's Lounge as follows: by email act@theactorslounge.co.uk

Bookings

Your Booking enters you into a contract with us to purchase a place on the Course. We are free to accept or decline your Booking at our discretion. At the point of our confirmation, a Contract will come into existence between you and The Actor's Lounge. The Contract will continue until the completion of the Course, unless it is cancelled earlier in accordance with the cancellation terms.

Late Applications

You accept that if you submit your Booking or Application within two working days of the Course commencing, The Actor's Lounge will use reasonable endeavours to provide you with confirmation by phone or email and to provide you with the Course specific details as soon as possible.

Accuracy of Booking Data

By submitting your Booking, you confirm that all information provided to The Actor's Lounge is correct. The Actor's Lounge reserves the right to review and cancel any Booking if any information provided is found to be incorrect.

Minimum Requirements

Participants are responsible for ensuring that they have the correct immigration status or visa to study in the UK (not applicable for any online courses).

Participants should take note of any specified minimum requirements before booking a Course or accepting an offer, these may include minimum age, English language ability, experience required for a level of training or physical and mental stamina.

All of our Courses involve the exploration of emotion and psychology.Participants therefore require a good level of mental stamina.

Please be aware that if you book onto a Course without being able to meet the minimum requirements, we will not be able to honour your Booking.

Minimum Age Requirement

You understand that The Actor’s Lounge cannot accept your Booking or Application if you are aged under 18. By submitting your Application for any Course not advertised as being for persons under the age of 18, you accept that you warrant to The Actor's Lounge that you are aged 18 or over. You accept that if this warranty turns out to be incorrect, The Actor's Lounge will be entitled to cancel the contract on written notice to you.

Access Needs and Reasonable Adjustments

Our courses are practical by nature and some individual sessions involve specific exploration of movement and physical theatre.

If you have any access needs or health needs that require reasonable adjustments, we encourage you to let us know so that we are able to put support in place.You are also able to contact support@theactorslounge.co.uk to talk this through with us in advance of your making a booking.

Please note that the details you disclose to The Actor’s Lounge will be passed on to the Core and Visiting Tutors when you book onto a Course so that we can accommodate your needs.

Health and Safety

The Actor's Lounge fully recognises and accepts its responsibilities with regards to health and safety. However, it is also incumbent on all participants to be mindful of their own health and safety and the health and safety of others. Participants should understand that they should not, either through action or inaction, put themselves or others at risk.

Participants should follow all instructions from staff and observe all policies, signage and messaging. If you do not understand a notice or sign please ask your Tutor or contact support@theactorslounge.co.uk

Fire exits are clearly marked throughout the venues that we use. If there is a fire or if you hear the fire alarm, you should make your way out of the Session through the nearest possible exit to the advertised assembly point outside.

If you suffer an accident or injury during a Course, or you have any health and safety or welfare concerns, you must report it and the circumstances to your Tutor and/or to support@theactorslounge.co.uk as soon as possible.

Fees and Payment

The Fees payable are published on the website. Fees are listed and payable in GBP. If you are paying in a different currency, you are responsible for any additional transaction fees associated with an international payment. Payment in full is made at the time of Booking and before the start of the Course unless the instalment option is selected on the payment portal. Your Booking is not completed until the Fees have been paid or an instalment arrangement confirmed. We are unable to reserve a place on a Course without payment of the initial deposit.

Deposit and Instalments

The deposit to reserve a place on each course is £75.

Once your deposit is paid the remainder of the course fee (one full payment) is due no less than 21 days before the course start date.

If the application for the course is submitted within the 21-day period before the beginning of the course, the full fee is due at the time of the application.

For any courses where payment can be made in instalments, payment deadlines must be met in accordance with the agreed schedule.

From time to time The Actor’s Lounge may offer promotional offers or discounts on courses at their discretion. Discounts may be withdrawn by The Actor’s Lounge at any time. Discounts must be used at the time of booking and will not be applied retrospectively.

Cancellation & Refunds

If you are a consumer and you are not entering into the Contract for purposes connected with a business, then you have legal rights under the Consumer Contract Regulations 2013 to cancel the Contract within 14 days (the "Cancellation Period") of the date of conclusion of your Contract (the date you book your Course). You accept that the Cancellation Period will expire 14 days after the date of the Booking (the date you book your Course).

If you wish to cancel your Booking within the Cancellation Period and request a refund, please send an email to act@theactorslounge.co.uk within 14 calendar days of the date of your (first) payment.

However, you acknowledge that if the Course begins during the 14-day Cancellation Period, you will be liable for the Course Fees for any part of the Course that takes place until we receive your written confirmation of cancellation. As a result, The Actor’s Lounge will be entitled to deduct a reasonable sum for the Services provided based on the proportion of the Course that has started from any refund payable to you.

You may also cancel the Contract after expiry of the Cancellation Period. You accept that in these circumstances you will remain liable for the Course Fees and will not be entitled to a refund of the Course Fees paid except in the circumstances laid out below. Please note that you cannot transfer the fees to another course.

If you provide The Actor's Lounge with written notice to cancel your Booking outside of the Cancellation Period but at least 21 days before the Course starts, you will be entitled to a refund of the Course Fees paid minus a 25% administration fee. To request a refund, please email act@theactorslounge.co.uk stating which Course you have booked on to, your name and Course location.

If you provide The Actor's Lounge with written notice to cancel your Booking outside of the Cancellation period and fewer than 21 days before the Course starts, you will not be entitled to any refund of the Course Fees or to transfer the fees to another course. You must notify The Actor's Lounge by email to act@theactorslounge.co.uk

Once a Course has started we are unable to offer any refunds and the Fees become fully non-refundable. This covers all possible reasons that you may seek a refund including due to ill health or Covid-19 of yourself or a family member, issues with technology (for online courses), failure to obtain a visa, if you change your mind, travel or transport disruption etc.

Non-attendance at classes due to reasons other than The Actor's Lounge’s default does not entitle you to refunds, extra tuition or a transfer.

Cancellations by The Actor’s Lounge

Where possible we endeavour to run all our Courses as advertised. However, The Actor’s Lounge reserves the right to reschedule or cancel a Course or Session.

Reasons for this may include, but may not be restricted to, low enrolment numbers, weather warnings and tutor/lecturer availability. In the event we are unable to run a session as part of a Course, we will make every reasonable effort to either reschedule the session to cover the missing hours.

Courses will only commence if we receive the minimum number of bookings on the Course. In the event that the minimum number of participants required is not achieved before the Course begins we will unfortunately need to cancel the Course.

Should a Course be unable to run we may cancel our contract, and we will endeavour to inform you no less than 7 calendar days before the Course starts, in which case you can either: Transfer onto an alternative Course, subject to availability (and receive a partial refund of the Course Fees if the Fees for the alternative Course are less than the Course Fees you originally paid or be charged for the difference between the Course Fees if the alternative Course is more expensive); or Cancel the Contract and receive a full refund of any Course fees paid.

Refunds

We will not refund any travel, equipment, materials you have purchased to attend a Course. Travel costs will not be reimbursed, regardless of whether you cancel your Contract/Booking, or we cancel the Course.

Where a refund is due we will process the refund according to the method of payment used to make the Booking. If you request a refund more than six months after your Booking, you will be required to re-send us your bank details. Under the GDPR, we cannot store this information for longer than six months.

Refunds will be paid in GBP. We are not responsible for any losses you suffer as a result of currency fluctuations.

Please allow 10 working days for a refund to reach your account.

The Actor’s Lounge’s Rights to Make Changes

We will endeavour to deliver the Courses and Sessions as publicised. However, we reserve the right to make changes to the Course as follows:

Publicised course tutors, artists and guest speakers (web and print form) may be subject to change.The timetable for the delivery of the Course may be subject to change.

Dates and locations for delivery of the Course may be subject to change.

We may make changes to the Course which are necessary to ensure it complies with any applicable laws or requirements.

The Tutors on the course are working professionals from the industry. However, due to the unpredictable nature of the acting industry, Tutors may be called at short notice to work.

In the event of any changes to the Course, we will endeavour to give as much notice as possible and in the event we are unable to run a Session as part of a Course, we will make every reasonable effort to either reschedule the session to cover the missing hours.

The Actor's Lounge shall not be responsible for any failure to perform or delay in performing our obligations under the Contract that is due to an event outside our control. If an event outside our control takes place which affects our obligations under the contract then we will contact you as soon as reasonably possible to notify you. Our obligations under the contract will be suspended for the duration of the event outside our control. We will restart the services as soon as possible when the event outside our control is over and it is safe and appropriate to do so.

Conduct

The Actor’s Lounge expects all participants to conduct themselves at all times in accordance with The Actor’s Lounge Code of Conduct, a copy of which will be sent to all participants.

Due to the content of the work undertaken, participants will be required to demonstrate high levels of maturity and sensitivity whilst participating in their chosen course.

Our Right to End the Contract

We may end the Contract if:

There is a breach of the Student Code of Conduct.

You disrupt the course and the tutor feels this is affecting your learning and affecting the learning of others.

Behaviour is such that it results in property damage, endangering others or self or impedes the progress of other participants. Participants will be held financially responsible for any damages.

We will not tolerate our staff or other Students being verbally abused or intimidated or being physically threatened. If we find this to be the case, we have the right to report you to the police, to ban you immediately and permanently from The Actor’s Lounge.

You do not make payment to us, before the start of the Course, or within your agreed payment plan schedule or in accordance with published payment deadlines.

You do not have a satisfactory visa or do not maintain an immigration status that entitles you to undertake the course.

If we end the contract due to any of the reasons outlined above, you will not be entitled to a refund.

Safeguarding

The Actor's Lounge is committed to Safeguarding and all students will be provided with a copy of The Actor’s Lounge Safeguarding Policy.

Your obligations

Maintain and be able to evidence your immigration status that entitles you to undertake the Course.

Attend classes for the Course regularly and on time. Inform the Tutor if you are going to be late or miss classes/sessions.

Have sufficient English Language Skills to cope with course demands. Sessions are delivered in English, so if you are not a native English Speaker it is important that you have sufficient English language skills to cope with the demands of the course. We are not able to offer translation assistance. Proof of language qualifications is not required but we work to the Common European Framework of Reference for Languages (CEFR) and its self-assessment table for English. We recommend at least B2 proficiency. This is approximately equivalent to IELTS level 6 or above.

Do not use audio or visual recording equipment during classes or practical sessions.

Comply with The Actor's Lounge’s Health and Safety rules as notified to you, including by wearing suitable clothing and footwear for practical classes.

Comply with the Student Code of Conduct.

Conduct yourself in a respectful and courteous manner and refrain from causing offence or nuisance to The Actor's Lounge, its staff or other participants.

Have the equipment and materials required for the Course as stated on the website or in the course information when applicable.

Only use any facilities and equipment provided by The Actor's Lounge during the stated hours for the delivery of the Course.

Do not provide access to, or share login details or content of the courses with any Third Parties.

Assessment and Credit including Spotlight Accreditation

In order to qualify for The Actor's Lounge’s Spotlight Accreditation, you must have completed 6 terms over 3 years. You must attend at least 8 out of the 10 sessions per Course and at least 4 out of the 6 Showcases over the 6 terms.

Participants who qualify for Spotlight Accreditation and have met the requirements, should submit an e mail request to act@theactorslounge.co.uk for written confirmation which can then be forwarded to Spotlight directly by the Participant.

The Actor's Lounge will only issue, upon request, digital confirmation of attendance and not certificates of attainment of a particular grade, qualification or standard.

Insurance

The Actor's Lounge has public liability insurance. It is recommended that participants take out insurance cover, including cover for theft and the loss of fees in the event of illness or accident.

Complaints

If you have any complaints about the services, you should raise this by contacting support@theactorslounge.co.uk and a copy of our complaints procedure will be provided to you.

Feedback

The Actor's Lounge may contact you to ask for your feedback on the Course.

Photographic and Video Consent

We use and retain photographs and videos of participants of all ages from our courses for promotional purposes. By booking, you agree to let us use photograph(s) and video(s) of your participation in the course, for publicity for The Actor’s Lounge.Photographs and video taken during courses, events, rehearsals, productions and concerts may be used by The Actor’s Lounge for publicity purposes and this might include using your name. All photographs, video and audio remain the property of The Actor's Lounge.The unauthorised use of professional equipment for photographing, filming, recording or transmitting (by digital or other means) any audio, visual or audio-visual material is strictly forbidden.

For activities open to external audiences such as end-of-course showcases, attendees give their express consent to their actual or simulated likeness to be included within any film, photograph, audio and/or audio-visual recording to be exploited in any and all media for any purpose at any time throughout the world. This includes filming by the police or security staff or CCTV at our venues which may be carried out for the security of attendees.

Please let us know at act@theactorslounge.co.uk if you do not want us to use any photos or videos of you or your name on social media or for publicity purposes.

Any personal photographs or video recordings you take during your course are strictly for private use and must not, under any circumstances, be posted on the internet or be used publicly in any way. If you become aware that images are being used inappropriately, you should inform us immediately.

Use of Data

You agree to The Actor's Lounge processing personal data contained in your booking form, or other data which the The Actor’s Lounge may obtain from you or other people, for purposes connected with your studies, health and safety or for any other legitimate reason.

The Actor's Lounge is committed to upholding your privacy and taking care with the personal information that you may give us. From 25 May 2018, we process your personal data in accordance with the General Data Protection Regulations (or GDPR for short). The Actor's Lounge will process personal data contained in this form or otherwise supplied by yourself or other people, for purposes connected with your studies, your health and safety, or for any other legitimate reason connected to your studies. Any information supplied by a participant that is found to be false or misrepresented may lead to expulsion from The Actor’s Lounge.

Privacy statement: The Actor’s Lounge processes personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. For full details of how and why The Actor’s Lounge processes personal data, please refer to our full privacy notice on our website. Alternatively, you can request a hard copy. Please direct all data protection queries to support@theactorslounge.co.uk. The Actor’s Lounge will process personal data as requested for the purposes of internal analysis, public reporting, research, marketing and fundraising in respect of our activities. All information collected about you will be stored securely and will not be shared with anyone without first being anonymised, unless we have sought express permission to attribute your views to you. We may share your data in a non-aggregated and anonymised form with third party project partners. We consider very carefully which organisations we partner with and put a contract in place that sets out our expectations and requirements, especially regarding how they manage the personal information they have collected or have access to.

Liability

The Actor's Lounge does not accept liability for personal injury or the death of any participant. The Actor’s Lounge does not accept any liability for the loss or damage of any property belonging to participants, and will not take charge of personal items left behind at the end after classes.

By attending a Course, you are acknowledging that an inherent risk of exposure to COVID-19 exists in any public place where people are present. Participants acknowledge that they do so at their own risk.

Nothing in these terms and conditions is meant to limit any rights you might have as a consumer.

Acknowledgements

By submitting an application to The Actor's Lounge, you agree to the terms and conditions above in which the following expressions will have the following meanings:

"Booking” means your application or booking for a place on a Course that is made through submitting your Booking Form and payment; your booking enters you into a binding contract with us to purchase a place on the Course.

"Booking Date" means the date you submit your Booking Form as part of the Booking process;

"Booking Form" means the online Booking Form or Application Form;

"Course" means the course and mode of study set out on The Actor’s Lounge Website which includes any of the courses (in person evening courses) that you agree to Undertake;

"Data Protection Laws" means the European Union Data Protection Directive 95/46/EC, any national laws or regulations implementing that Directive, the General Data Protection Regulation EU 2016/679 ("GDPR") (when applicable) and any national laws or regulations constituting a replacement or successor regime to GDPR;

"Event Outside The Actor's Lounge’s Control" means an event or circumstances beyond The Actor’s Lounge’s reasonable control, such as:

(a) strikes, lock-outs or other industrial action by third parties;

(b) strikes, lock-outs or other industrial action by our employees;

(c) civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, adverse weather, subsidence, or other natural disaster or “act of god”;

(d) failure of public or private telecommunications networks;

(e) pandemic, epidemic and any restrictions or requirements that might be imposed by any Government or relevant authority, and will include, for example, any disruption caused as a result of COVID-19; and/or

(f) decisions made by any Government or relevant authority or regulator that impact on our ability to perform our obligations under the Contract, including, for example, any changes made by any Government regarding examination results;

"Fees" or “Course Fees” means the courses fees and administration fees payable by you in relation to the Course as well as additional fees when applicable;

“Online” means any online virtual platform;

“Online Course” means any learning that The Actor’s Lounge might deliver online from time to time;

“Our” means the The Actor’s Lounge Team responsible for the development, organisation and delivery of the courses;

“Participant” means the person who has made a booking onto a Course, or the person who will attend the Course if the booking has been made on their behalf, or the person enquiring about a Course;

"Personal Data" means any information relating to an identified or identifiable person ("data subject"); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person;

"Sensitive Personal Data" means data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, genetic data, biometric data, data concerning health or data concerning a natural person's sex life or sexual orientation;

"Services" means the teaching services and related teaching materials that Courses will provide in relation to the Course;

“Session” means a lesson;

“The Actor's Lounge” means The Actor's Lounge;

“TAL” means The Actor’s Lounge;

“The Actor’s Lounge Office” means the contact details provided in the joining instructions or sent before you commence the Course;

“We” means the The Actor’s Lounge Team responsible for the development, organisation and delivery of the courses;

"Website" means The Actor's Lounge website at theactorslounge.co.uk

“Writing” or “Written” includes emails.

“You” refers to the person who has made the booking or is enquiring about a Course.
